By accessing or using Adsper ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, do not access or use the Service.

2. Description of Service

Adsper provides an AI-powered advertising generation platform that enables users to create static and video advertising creatives using AI-generated actors, product imagery, and text overlays. The Service is intended for marketing and commercial use.

3. User Accounts

Access to certain features requires account registration. You agree to provide accurate, current, and complete information and to keep such information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.

4. Intellectual Property Rights

Your Content You retain ownership of all content you upload to the Service, including product images, prompts, and inputs.

Generated Content Subject to compliance with these Terms and payment of applicable fees, Adsper grants you a perpetual, worldwide, non-exclusive, royalty-free license to use, reproduce, display, modify, and distribute ad creatives generated through the Service for commercial and non-commercial purposes.

Adsper retains all rights to the underlying platform, models, software, actor likeness licenses, and generation infrastructure.

5. Payment, Trials, and Credits

The Service may operate on subscription plans, usage limits, or credit-based systems depending on the plan selected. Payments are processed via Stripe. Fees are non-refundable unless required by law. Subscriptions renew automatically unless canceled before the end of the billing period. Trial access may be limited and subject to additional restrictions.

6. Prohibited Uses

You agree not to use the Service to create or distribute content that is unlawful, deceptive, infringing, harmful, abusive, defamatory, obscene, hateful, or otherwise objectionable. You may not misuse actor likenesses, impersonate individuals, or violate advertising platform policies. Adsper reserves the right to suspend or terminate accounts that violate these Terms.

7. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. Adsper makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

8. Limitation of Liability

To the maximum extent permitted by law, Adsper shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill, arising from or related to your use of or inability to use the Service.

9. Changes to Terms

Adsper may modify these Terms at any time. Updated Terms will be posted with a revised effective date. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
